Welcome to AnswerPack. By using our Service, you agree to these Terms of Service. Please read them carefully, particularly the sections on AI-generated content and your verification responsibilities.

1. Definitions

"Service" refers to the AnswerPack web application and all related services. "Output" refers to any AI-generated content including draft responses, answer suggestions, matched answers, and exported questionnaire responses. "User" or "You" refers to any individual or entity using the Service. "We," "Us," or "Company" refers to AnswerPack and its operators.

2. User Verification and Human-in-the-Loop Requirement

(a) Draft Nature of Output

The Service uses artificial intelligence to generate draft responses, suggestions, and "Answer Packs" (collectively, "Output"). All Output is provided on an "as-is" and "as-available" basis for informational and drafting purposes only.Output does not constitute professional, legal, financial, or compliance advice.

(b) Mandatory Human Review

User acknowledges that the Service is a tool to assist, not replace, professional judgment. User agrees to a "Human-in-the-Loop" workflow, whereby a qualified human representative of the User must review, verify, and approve all Output for accuracy, completeness, and compliance with applicable laws and industry standards before such Output is:

  • Shared with third parties (including clients, prospects, or auditors)
  • Used in any binding contractual capacity
  • Submitted as part of an RFP, security assessment, or compliance audit
  • Relied upon for business decisions

(c) Responsibility for AI Errors and Hallucinations

User acknowledges that AI systems may occasionally produce "hallucinations" (factually incorrect, outdated, or nonsensical information). The AI matching system may suggest answers that are contextually inappropriate or inaccurate for specific questions. User assumes all risk for the use of unverified Output. It is User's sole responsibility to verify all facts, technical specifications, compliance claims, and contractual representations before use.

3. Limitation of Liability

(a) Disclaimer of Warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Output will be accurate, reliable, complete, or free from error. We specifically disclaim any warranty of fitness for a particular purpose, including but not limited to:

  • The success of any B2B bid, RFP response, or contractual negotiation
  • Compliance with any specific security framework (SOC 2, ISO 27001, etc.)
  • The accuracy of matched answers or confidence scores
  • The completeness of exported questionnaire responses

(b) Cap on Damages

To the maximum extent permitted by law, Company's total liability for any claim arising out of or relating to the Service—whether in contract, tort (including negligence), strict liability, or otherwise—shall not exceed the total fees actually paid by the User to Company during the six (6) months immediately preceding the event giving rise to the claim.

(c) Exclusion of Consequential Damages

IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY:

  • Lost profits or revenue
  • Loss of business opportunity or goodwill
  • Loss of data or data breach costs
  • Failed RFP submissions or lost contracts
  • Compliance failures or audit deficiencies
  • Any indirect, incidental, special, or consequential damages

This exclusion applies even if Company has been advised of the possibility of such damages and regardless of whether the claim is based on contract, tort, or any other legal theory.

4. Data Privacy and Security

We take the security of your data seriously. Your Answer Library, Evidence Vault, and questionnaire data are isolated by workspace using row-level security policies. We process your data in accordance with our Privacy Policy, which incorporates compliance with applicable data protection laws including the California Consumer Privacy Act (CCPA), the California DELETE Act of 2026, and other applicable state and federal regulations.

You retain all rights to the content you upload to the Service. We do not use your proprietary answers or evidence files to train AI models or share them with third parties except as necessary to provide the Service.

5. Acceptable Use

You agree not to use the Service to:

  • Submit false or misleading information in questionnaire responses
  • Misrepresent your organization's security posture or compliance status
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Attempt to circumvent security controls or access other users' data

6. Indemnification

You agree to indemnify, defend, and hold harmless Company and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service or any Output
  • Your failure to verify Output before use
  • Any misrepresentations made using Output generated by the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation

7. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
